The Telford Borough Council meeting held this date was called to order at 7:31 p.m. by President Robert Baker with the following members in attendance:  J. Allen Landis, Carolyn Crouthamel, John Harrell, Stanley Nyce, and Scott Hillegass.  Jeffrey Maxwell was absent.  Also present were Mayor Jay Stover, Manager Mark D. Fournier, Recording Secretary Cathy Fried, Solicitor Mark E. Weand, Jr., and press reporters.  Souderton-Telford Main Streets Manager Pamela Coleman arrived at 8:00.  In the audience was borough resident Linda Morris. 

The invocation was given by Stanley Nyce, followed by the pledge of allegiance.

A Landis / Crouthamel motion was carried unanimously (6-0) approving the July 6, 2009 minutes.

TREASURER'S REPORT:   was unanimously (6-0) approved by a Hillegass / Crouthamel motion.  

MAYOR'S REPORT:   

Mayor Jay Stover reported he attended the July Borough Council meeting and the Library Board meeting.  He was a judge / taster at the Farmer's Market Field to the Table Festival.

POLICE REPORT: 

Attached are our service calls and citations issued for the month of July.

In addition to routine, assigned shifts:

  1. I attended a Civil Service Commission Meeting.
  2. Lieutenant Floyd attended several meetings; his report to follow at a later date.
  3. Officers Fox and Kim participated in a DUI Roving Patrol; see attached report.
  4. Officer Minninger attended the monthly North Penn Tactical Team practice.
  5. Officers provided traffic control for the Moyer & Son 5K race.

I have attached a letter of thanks and newspaper articles for you to peruse.

FIRE REPORT:  We received a written monthly report for the file.

LIBRARY REPORT:  No report.

Mayor Jay Stover reported the state budget has cut funding to libraries by approximately 50%.  This will not affect the proposed addition to the Indian Valley Public Library.  The Library has submitted an application for zoning variance.

PUBLIC WORKS REPORT:  

1. Centennial Park - Nothing at this time.

2.   Stover Park - Installation of the electrical conduit is complete and the control panel base has been installed.  The components for the control panel have been ordered.  Swartley Brothers will install the wire and components when they arrive.

3.   Mowing - Mowing of Borough buildings, parks and athletic fields is on-going as required.

4.   Community Building - We installed a plexiglass window to cover a broken window sash at the Community Building.

5.   Summit Avenue Project - On July 24th we installed the wearing course along Summit Avenue between Main Street and School Lane.  This is a shared project with Telford Borough Authority.

MANAGER'S REPORT:

  • Reviewed various building / zoning permit applications and land development plans with the Zoning Officer and the Solicitor.
  • Attended various meetings with regard to Borough Council and Telford Borough Authority.
  • Attended the Indian Valley Chamber of Commerce Economic Development Committee meeting.
  • Met with Moyer and Son to discuss renovations to their fuel center.
  • Met with a representative of Penn State Lehigh Valley to discuss what education opportunities they can offer Telford Borough.
  • Met with the Main Streets Manager regarding the proposed parking lot sign design and location.
  • Coordinated a meeting with the Lutheran Community design consultants and their staff with our Building and Zoning officials to discuss technical design questions regarding the building / fire codes and our interpretation.
  • Met with an engineer to tour our public works garage and help him with his design project with suggestions.
  • Met with a property owner and our Building Official to discuss a shed permit / building location.

Manager Mark Fournier reported there is a lot of Authority activity that includes the sewer pipeline relining project on Reliance Road.  Donald Beck is working on the sewer line project on Main Street near Lenape Lane.

Mark Fournier also mentioned the September Borough Council meeting will be held on Tuesday, September 8th because of the Labor Day holiday.

BUILDING OFFICIAL'S REPORT:  We received a written monthly report for the file.

Mark Fournier reported the number of Use & Occupancy inspections has increased during the past couple months.

SOLICITOR'S REPORT:

1. ZONING. (A) The Solicitor continues to confer with Mark Fournier to discuss pending building, zoning and inspection matters. All material is reviewed by the Solicitor on receipt for advice submission. (B) Rock Community Church Zoning Application. There remains no update with regard to the sale of this property or zoning implementation.  Pending Solicitor contact, this item will be deleted from further report.  (C) Joseph Nitterour Zoning Application.  By adoption of Ordinance No. 379 on July 6, 2009, the Applicant's property situate 261 W. Broad Street became conforming.  Accordingly, zoning relief is no longer required whereby this matter can be concluded and deleted from further report.  (D)  Indian Valley Public Library Zoning Application.  The Solicitor has received and reviewed a Zoning Hearing Board Application from the Indian Valley Public Library pertaining to premises situate 100 E. Church Avenue.  The Applicant proposes a 2116 square foot addition which will encroach on the 15 foot setback requirement under Section 1104.B.3.b of the Telford Borough Zoning Ordinance.  No hearing date has been set at this time.  (E)  There are no other pending zoning applications at this time.

2. ASSESSMENT APPEALS. (A) MetPro Corp. Since last report, the fully executed Settlement Stipulation was been submitted for Court approval. The Solicitor has received an Order dated July 24, 2009 signed by Judge Drayer approving the Stipulation of Settlement. A copy of the Stipulation and Order has been submitted to the Manager for record retention. (B) Warren Lumber & Millwork, Inc. There remains no activity to report.

3. REVITALIZATION. All aspects of the Souderton/Telford Main Street Program continue to be discussed with the Manager.

4. BUDGET. Budget aspects are referenced with the Manager and Engineer as various projects are discussed.

5. SKLAR ACCIDENT CLAIM. There remains no contact from Plaintiff's attorney or her "special needs trust attorney." Accordingly, efforts to finalize the agreed settlement have not materialized at this time.

6. CENTENNIAL PARK IMPROVEMENTS PROJECT. The Solicitor continues to discuss the ground cover issue with the Manager and Engineer. Retainage continues to be held by the Borough until contractual compliance is met.

7. CHIPLEY CLAIM NOTICE. The Solicitor has received no contact on the Chipley Claim Notice. Apparently, there has been no activity.

8. CURBSIDE COLLECTION OF LEAF WASTE. (A) Ordinance No. 380 revising Sections 11 and 12 of Ordinance No. 368 addressing handling, collection and disposal of leaf waste was adopted by Council on July 6, 2009. Submission has been initiated to Mark A. Hosterman, Esquire, Solicitor for the Northern Montgomery County Recycling Commission. (B) Under discussion with the Manager is a Resolution to designate an approved PA-DEP Leaf Composting Facility as a drop-off location for haulers, borough residents, businesses and institutions. Such a facility would be the Barnside Farm Composting facility located at 430 Diebler Road in Schwenksville.

9. LANDIS SUPERMARKET. As previously referenced, traffic signals at the County Line and Church Road intersection require improvement. The cost aspects of this project continue under discussion with the Manager and Engineer.

10. INDIAN VALLEY LIBRARY COMMISSION: There has been no Solicitor contact since last report.

11. BUCKS COUNTY WASTE MANAGEMENT PLAN: The Bucks County Solid Waste Management Plan Revision remains pending with the Manager and Solicitor.

12. ZONING ORDINANCE AMENDMENT: Ordinance No. 379 amending the Code of the Telford Borough Zoning Ordinance No. 100 was adopted by Council on July 6, 2009. Legal requirements following adoption will be attended to.

13. PA DEP NPDES STORMWATER PERMIT REQUIREMENTS. The Solicitor has reviewed the written comments concerning the PA-DEP's draft NPDES Phase II Stormwater Permit Program Modifications that were prepared by CKS and submitted for consideration during the mandatory public comment period. All requirements pertaining to this initiative will be addressed as they arise.

14. LUTHERAN COMMUNITY AT TELFORD. The Solicitor attended the formal plan presentation by the Lutheran Community to the Telford Borough Planning Commission on July 14, 2009. Extensive review comments were prepared by CKS to which the Lutheran Community responded with a "will comply" format. Very few waivers appear to be necessary in view of the scope of this project. Items requiring resolution such as fire company and recreation contributions are being discussed. It is projected that a second meeting will take place in August with possible presentation to Council at its September 8, 2009 meeting.

FIRE COMPANY SIREN.  There has been no Solicitor contact subsequent to the public warning fire siren information presentation by Chief Ray Fegley on July 6, 2009.

Solicitor Mark Weand reported there has been no further communication with the Rock Community Church so this item will be deleted from his report.  The Nitterour zoning application is no longer necessary because of the recently approved zoning ordinance accommodates the proposed use so this item will be deleted from Mark Weand's report.  Mark Weand reported the Indian Valley Public Library zoning variance application has been received.  Attorney Steven Imms, Jr. is on the Library Board.  This is a conflict of interest so he will not be able to serve in his capacity as the Zoning Hearing Board solicitor.

The Settlement Stipulation has been submitted for court approval and was signed by the judge for the MetPro Corp. assessment appeal.  Mark Weand has advised Tax Collector Emiline Weiss and Financial Director Daphne Hollowbush that this decision will be more favorable to Telford Borough.

Mark Weand reported the Lutheran Community at Telford would like their application for Land Development for Phase I handled expeditiously and be presented to the Planning Commission at the earliest possible date.  It is hoped the Planning Commission will make recommendation in August and it will be presented to Borough Council in September.

ENGINEER'S REPORT

COMMENTS FROM AUDIENCE:  none  

FINANCE AND ADMINSTRATIVE COMMITTEE:  Mr. Hillegass

A-1       A Hillegass / Crouthamel motion was carried unanimously (6-0) approving the payment of bills in the amount of $230,321.90 for the month of July.

PLANNING & ZONING COMMITTEE:  Mr. Maxwell

PZ-1     Attorney Stephen Imms, Jr., solicitor of the Zoning Hearing Board, has recommended Attorney Michael Furey to sit at the hearing of the Indian Valley Public Library zoning variance application because Mr. Imms is a member of the Library Board.  Attorney Furey will charge $85 per hour which is the same amount charged by Attorney Imms.

            A Crouthamel / Landis motion was carried unanimously (6-0) approving Attorney Michael Furey to replace Attorney Stephen Imms, Jr. at the hearing of the Indian Valley Public Library zoning variance application.

ENVIRONMENTAL COMMITTEE:  Mr. Nyce

E-1       The Northern Montgomery County Recycling Commission has requested that Telford Borough sign a Compost Agreement that designates Barnside Farms Compost Facility as a drop-off facility for yard trimmings.  Telford Borough will continue to collect leaves.  Stanley Nyce reiterated the agreement is necessary to comply with DEP mandates.

A Hillegass / Crouthamel motion was carried unanimously (6-0) authorizing the appropriate officials to sign the Compost Agreement designating Barnside Farms Compost Facility as a drop-off facility for yard waste.

PUBLIC WORKS / BUILDINGS & PLANT COMMITTEE:  Mr. Landis

PW-1    Mark Fournier explained he received the Municipal Winter Traffic Services Agreement from PennDot that requires the signatures of Borough Council President and Secretary.  The Agreement provides for snow and ice removal on County Line Road from the north borough line to Central Avenue, on State Road from County Line Road to Emlen Way, and Church Road between Melvin Road and County Line Road.

            A Landis / Harrell motion was carried unanimously (6-0) authorizing the appropriate officials to sign the Municipal Winter Traffic Services Agreement.  

 

PUBLIC SAFETY COMMITTEE: Mr. Harrell

 

DEVELOPMENT & CULTURE COMMITTEE:   Ms. Crouthamel

 

DC-1     Souderton-Telford Main Streets Manager Pamela Coleman presented information regarding the Delaware Valley Regional Planning Commission Classic Towns program.  She distributed brochures of Classic Towns as a sampling of information that will be available about Telford Borough.  She further explained that being a member of Classic Towns is a good marketing tool that will be available on the internet through the Classic Towns website as well as being linked to the Telford Borough website.  Joining Classic Towns is on an invitation basis and is for a two year term.  The membership fee will be $2,500 per year with Souderton Borough paying one-half of the annual fee.  The funds from membership dues are used for advertising.  As of October 1st, the membership will be in the name of Souderton-Telford Main Streets.

 

            A Crouthamel / Harrell motion was carried unanimously (6-0) approving Telford Borough entering into a two year membership to Classic Towns for an annual fee of $1,250.
